1. Agreement to Terms

Welcome to XWheels. These Terms and Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using XWheels, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use our Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Description of Service

XWheels is a vehicle rental marketplace that connects customers ("Renters") with vehicle rental operators ("Operators"). We provide a platform for browsing, comparing, and booking rental vehicles from various Operators across Malaysia.

XWheels acts as an intermediary and is not the owner or operator of the vehicles listed on our Platform. The rental agreement is between you and the respective Operator.

3. Eligibility

To use XWheels, you must:

• Be at least 21 years of age (or older, as required by specific Operators)
• Hold a valid driver's license for at least 2 years
• Have a valid Malaysian IC or passport
• Provide accurate and complete registration information
• Have a valid payment method

4. Account Registration

To make bookings, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

5. Bookings and Payments

5.1 Making a Booking

When you make a booking through XWheels:

• You are making an offer to rent the vehicle from the Operator
• The booking is confirmed once payment is processed and the Operator accepts
• You will receive a confirmation email with booking details
• Vehicle availability is subject to Operator confirmation

5.2 Pricing and Fees

All prices displayed include applicable taxes unless otherwise stated. Additional fees may include:

• Security deposit (refundable)
• Late return fees
• Fuel charges (if vehicle is not returned with full tank)
• Additional driver fees
• Delivery/pickup charges
• Insurance coverage upgrades

5.3 Payment Methods

We accept major credit/debit cards and online banking. Payment is processed securely through our payment partners. By providing payment information, you authorize us to charge the applicable fees.

6. Cancellation and Refund Policy

Cancellation policies may vary by Operator. Generally:

• Free cancellation: Up to 48 hours before pickup time - full refund
• Late cancellation: 24-48 hours before pickup - 50% refund
• No-show/Last minute: Less than 24 hours - no refund

Refunds will be processed within 5-14 business days to the original payment method. Operators may have different policies; please review the specific cancellation terms during booking.

7. Vehicle Pickup and Return

7.1 Pickup Requirements

At pickup, you must present:

• Valid driver's license
• Valid IC or passport
• Credit/debit card used for booking
• Booking confirmation

7.2 Vehicle Inspection

Before accepting the vehicle, thoroughly inspect and document its condition. Report any existing damage to the Operator before departure. You will be responsible for any undocumented damage upon return.

7.3 Return Conditions

Return the vehicle at the agreed time and location, in the same condition as received. Late returns may incur additional charges. Return with the same fuel level as pickup or pay applicable fuel charges.

8. Renter Responsibilities

As a Renter, you agree to:

• Use the vehicle only for lawful purposes
• Not sublease or allow unauthorized drivers to operate the vehicle
• Comply with all traffic laws and regulations
• Not smoke in the vehicle
• Not transport illegal substances or contraband
• Not use the vehicle for racing, towing, or off-road driving
• Maintain the vehicle in good condition during the rental period
• Report accidents, theft, or damage immediately
• Pay for any traffic violations incurred during the rental period

9. Insurance and Liability

All vehicles come with basic insurance coverage as required by law. Coverage details vary by Operator and may be subject to excess/deductible amounts.

You are responsible for:

• Any damage to the vehicle not covered by insurance
• Loss of personal belongings in the vehicle
• Damage resulting from negligence or violation of Terms
• Third-party claims arising from your use of the vehicle

Optional insurance upgrades may be available at additional cost.

10. Limitation of Liability

XWheels is a marketplace platform and does not own or operate the rental vehicles. To the maximum extent permitted by law:

• We are not liable for the actions or omissions of Operators
• We do not guarantee vehicle availability, condition, or performance
• We are not responsible for personal injury or property damage
• Our total liability shall not exceed the fees paid through our Platform

11. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of XWheels or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Prohibited Activities

You agree not to:

• Use the Platform for fraudulent purposes
• Provide false or misleading information
• Interfere with the Platform's operation
• Attempt to gain unauthorized access
• Use automated systems to access the Platform
• Harass or abuse other users or Operators

13. Dispute Resolution

Any disputes arising from these Terms or your use of XWheels shall be resolved as follows:

• First, contact our support team to attempt informal resolution
• If unresolved, disputes may be submitted to mediation
• Failing mediation, disputes shall be governed by Malaysian law and subject to the jurisdiction of Malaysian courts

14. Termination

We may suspend or terminate your access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, Operators, or XWheels. Upon termination, your right to use the Platform will cease immediately.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
